First Flashcards Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the First Flashcards mobile application (“App”). By downloading, installing, or using the App, you agree to these Terms.

1. Agreement

These Terms are a legal agreement between you and Lee Ka Yip (“Developer,” “we,” “us,” or “our”), not Apple. The Developer is solely responsible for the App and its content

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, subject to these Terms and Apple’s App Store terms.

3. User Content

You may create, upload, store, or organize flashcards, text, images, and other materials through the App (“User Content”).

• You retain ownership of your User Content.

• You grant us a limited license to host, store, process, and display your User Content only as needed to operate the App.

• You are responsible for ensuring that your User Content does not violate any law or infringe any third-party rights.

4. Prohibited Use

You agree not to:

• Use the App for unlawful, harmful, or fraudulent purposes.

• Upload content that is abusive, obscene, infringing, or otherwise illegal.

• Reverse engineer, modify, decompile, or attempt to extract the source code of the App.

• Interfere with the security, performance, or operation of the App.

5. Privacy

Your use of the App is also subject to our Privacy Policy. We may collect and process limited information necessary to provide the App and improve performance.

6. Payments and Subscriptions

If the App offers paid features, subscriptions, or one-time purchases, those transactions are handled through Apple’s payment systems. Any subscription will automatically renew unless canceled in your Apple account settings before the renewal date.

7. Intellectual Property

All rights, title, and interest in and to the App, including its design, code, branding, and features, belong to Lee Ka Yip or its licensors, excluding your User Content.

You may not copy, distribute, sell, or create derivative works based on the App without permission.

8. Disclaimer

The App is provided on an “as is” and “as available” basis. We do not guarantee that the App will always be error-free, uninterrupted, or suitable for any particular educational outcome.

9. Limitation of Liability

To the maximum extent permitted by law, Lee Ka Yip will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

10. Termination

We may suspend or terminate your access to the App if you violate these Terms or use the App in a way that may harm the App, other users, or the Developer. You may stop using the App at any time by deleting it from your device.

11. Apple Terms

Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the App or by other reasonable means. Continued use of the App after changes become effective means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of Hong Kong, unless otherwise required by applicable law.
